The Works Council's Right to Advise When Changing the Legal Form of the Employer

Anika Bongers

Anika Bongers has been working in the Employment Law Group of Kennedy Van der Laan since 2003. Anika engages in all aspects of employment law. The majority of her clients are national and international businesses, but she also assists private individuals. Anika regularly defends her clients in court.

Anika specializes in guiding reorganizations from A to Z, sometimes in the scope of her secondment to clients. In the past years, Anika has given guidance to various clients in large and small reorganizations, both in the preliminary phase – when drafting the collective redundancy notification and negotiating/drafting the social
plan –, and in the implementation of the reorganization, involving for example the application of the principle of proportionality, and preparing and conducting dismissal proceedings.

Anika also advises both employers and works councils on aspects of employee co-governance law. As a member of the Employment Law Association, Anika was part of the Employee Co-Governance Law Working Group. This working group prepared the Recommendations for the evaluation of the Dutch Works Councils Act 2009/2010 for the Minister of Justice.

Anika has been an NMI Certified Mediator since 2009 and she regularly handles mediations in the field of employment law.
